The Auctioneer is responsible for marketing the property, qualifying bidders, collecting payments, ensuring sales tax compliance, coordinating title transfers, and resolving disputes between the Seller and Buyer. They also provide post-auction reports and ensure smooth operation of the auction platform.
The Seller must facilitate inspections, provide accurate property disclosures, supply ownership documentation, and ensure timely property release after payment. The Seller also needs to maintain clear communication with the Auctioneer and comply with all terms outlined in the agreement.
The Seller grants the Auctioneer exclusive rights to sell the item(s) listed in the Agreement. The Seller cannot sell the items through other venues while under contract with the Auctioneer. If the Seller withdraws the items, they are required to reimburse the Auctioneer for incurred expenses and pay a liquidated damage fee.
Yes, the Auctioneer reserves the right to postpone or cancel the auction in cases of technical issues, bidding errors, or emergencies. Postponed items may be re-listed in a future auction.
The Auctioneer will assist in resolving disputes between the Buyer and Seller about the condition of the property. The Auctioneer remains neutral and is not liable for losses resulting from the dispute.
The Seller must maintain appropriate insurance coverage for the property until it is transferred to the Buyer to protect against any potential loss or damage.
The Auctioneer will make reasonable efforts to collect payment from the winning bidder, but cannot guarantee payment. Sales tax will still be collected, and the Auctioneer may retain any interest or credits earned while awaiting disbursement.
Yes, the Seller agrees to pay the Auctioneer fees for listing, commissions, administrative costs, and any other fees as stated in the Agreement. The Auctioneer may also collect a buyer's premium and late payment fees from winning bidders.
Disputes related to the auction or agreement are governed by the laws of the State of Texas. Any legal actions must be resolved in a Texas court of competent jurisdiction.
If the Seller cancels or withdraws items after listing them, they are responsible for reimbursing the Auctioneer for all incurred expenses, including marketing costs and administrative charges, as well as paying liquidated damages.
